Jasper Lubeto

• Jasper Lubeto is an Advocate (Attorney at Law) practicing in the East African Courts with a bias for Kenya, Uganda and Tanzania laws. He focuses on both contentious and non-contentious legal work canvassing corporate and commercial transactions, disputes resolution, legal advisory, legal development & aid work, climate change adaptation & mitigation, legal research, and legal aid & justice.

• He has been largely involved in dispute resolution on complex commercial and land & environmental matters. He has litigated and resolved complex land matters on ownership, access, adverse possession, land tenure rights, land expropriation, land compensation, land compulsory acquisition, land boundaries, land adjudication, land succession, land conservation, and contested land acquisitions making me a common fixture in Environment & Land Courts across Kenya. He is enthusiastic of land matters – studying it in his prospective PhD, teaching it at the University, advising on numerous conveyancing transactions, and litigating the matters – pretty much everywhere in the land/conveyancing legal value chain!

• In commercial litigation, he has mostly focused on dispute resolution in various arbitral tribunals, Tax Appeal Tribunals and at the High Court (Commercial) resolving matters on shareholder rights & duties, company taxation, company structures, and application of various company law provisions provided under the Companies Act, 2015. He is among the first litigants on the right of the minority to force the majority to buy them out! He has also resolved numerous employment disputes on constitutional rights violations, redundancies, and breaches of consultancy and employee contracts.

• In corporate matters, he advises on corporate structuring, contracts and employment, labour and consultancy relations. He appreciates the workings of the Companies and LLP Registries in Kenya; and I have facilitated numerous companies’ incorporations & structuring both at local and international level with beneficial regulatory arbitrage outcomes. He also serves as a Company Secretary sitting in diverse corporate boards where he records the proceedings/minutes, advise the boards on governance & legal matters. He is particularly involved with real estate, IP & Technology, Banking & Finance industries’ related boards.

• He holds a LLM in Economic & Business Law from UZH, LLB from UoN, Certified Secretary under ICSK, and a CPA (Kasneb). He is currently advancing his studies in International Arbitration Law with particular focus on construction and commercial disputes resolution.

• Jasper serves as the Managing Partner providing overall coordination particularly for the Nairobi office.

Some of Jasper’s achievements are:

• Currently defending an appeal where the Respondent was awarded compensation of Kshs. 4.5 billion at the Court of Appeal.

• Resolved complex litigation on land and environment matters at the ELC Courts in Kisii, Nakuru, Kisumu, Mombasa, and Nairobi. Currently on record for parties on contentious land matters encompassing land boundaries, land acquisition, contested & fraudulent land transactions, and land compensation in various Environment and Land Courts in Kenya.

• Successfully advised Victoria Green Investment (SEZ) Limited on a multimillion project on climate change and adaptation in the Lake Region Economic Block.

• Currently prosecuting/defending commercial, labour, criminal, constitutional and civil matters at both the High Courts and Magistracy Courts countrywide.

• Currently advising and is on record for several mid-tier companies in TMT, Engineering Contracting Services, Medical & Pharmacy, Real Estate, and Finance.

• Successfully advised on numerous conveyancing matters leading to registration of transfers, charges, subdivisions, and other land approvals.
